LUDINGTON — A 32-year-old man with a long criminal history pleaded guilty in Mason County’s 51st Circuit Court Wednesday, March 12, to one felony count of attempting to disarm a police officer, two felony counts of assaulting/resisting/obstructing police and a misdemeanor count of assault and battery.
Marshall Jennings Brault also pleaded guilty to fourth-offense habitual offender, said Mason County Prosecuting Attorney Beth Hand.
“These crimes occurred in the City of Ludington on Aug. 25, 2024,” said Prosecutor Hand. “Defendant was on parole at the time of the offenses.
“Defendant entered into a Cobbs agreement with the court, wherein the court agreed to sentence the defendant to prison for a period of 53 months (four years and five months) to a term of years,” said Hand. The maximum term has not yet been determined.
“This sentence will be served consecutively to any additional time the defendant receives from the Michigan Department of Corrections for violating his terms of his parole.” He was paroled July 11, 2023, according to MDOC records.
“If the court decides at the time of sentencing that it is unable to abide by the terms of its sentencing agreement, the defendant will be allowed to withdraw his plea.” He is scheduled for sentencing May 6 at 10:50 a.m.
Brault fled from police in his vehicle and was found in possession of heroin at the jail, April 17, 2018. He was convicted of fleeing police and drug possession, and a charge of furnishing contraband to prisoners was dismissed. He was sentenced to two to 10 years in prison.
Brault was sentenced to five to 15 years in prison for arson June 18, 2013. He was one of two suspects involved in the breaking and entering of the Wishing Well convenience store in Pentwater Oct. 20, 2012. He was sentenced to two to three years in prison for a conviction of unlawful vehicle use.
Brault has also served previous prison terms for convictions of assaulting/resisting/obstructing a police officer, prisoner possessing contraband and breaking and entering, according to Michigan Department of Corrections records.
He is currently lodged in the Mason County Jail on a $250,000/cash/surety bond awaiting sentencing.
