Man pleads ‘no contest’ to attempted breaking and entering.

LUDINGTON — A 22-year-old Scottville man pleaded “no contest” in 51st Circuit Court Tuesday, Feb. 18, to attempted breaking and entering.

Jesse Allen Totten, of 1085 E. Hawley Rd., faces serving four months of a one-year discretionary jail term for the conviction. Totten’s attorney, Douglas Stevenson, said his client has nearly reached the four-month point since his arrest.

Totten testified that last November he attempted to steal items from a storage garage at Scottville furniture store, Holden’s Home Emporium, Inc.

The owner found the defendant in the morning hiding behind furniture in the garage, said Mason County Prosecutor Paul Spaniola. “He found items packed up for removal.”

Totten entered the building by climbing through a window, said Judge Susan Sniegowski.

In exchange for Totten’s plea, one count of breaking and entering a building and a third-offense habitual offender designation will be dismissed.

Attempted breaking and entering is punishable by up to five years in prison.

Sentencing is set for April 21 at 1:30 p.m.
