LUDINGTON — A 49-year-old Ludington man, who is a convicted sex offender, was sentenced in 51st Circuit Court Tuesday, Feb. 14, to serve nine months of a one-year discretionary jail term for a conviction of a high-court misdemeanor of fourth-degree criminal sexual conduct (CSC) and fourth-offense habitual offender.
Steven John Ziemkowski, of 607 Seventh St., pleaded guilty to the charge last month.
The female victim, who was 18 years or older at the time of the offense, suffers from fetal alcohol syndrome, said Mason County Prosecutor Paul Spaniola. “She is a very, very childlike young woman” whose “thought process is very limited… He’s related to her and very aware of her condition.”
Ziemkowski testified at an earlier court appearance that he inappropriately touched the victim at a location on M 116 in Hamlin Township.
As a convicted sex offender, Ziemkowski was facing a maximum term of 15 years in prison with his habitual offender status, Spaniola said previously.
“You were in a position to know better, and you took advantage of your position,” said Judge Susan Sniegowski, who also ordered that he serve five years probation.
Spaniola said Ziemkoski served 15 years in prison for a previous CSC conviction and was released in 2007.
Ziemkowski received credit for one day served in jail.
