79th District Court news, posted Sept. 3, 2021

LUDINGTON — The following were recently arraigned in Mason County’s 79th District Court:

Felonies

Nash

-James Arthur Nash, 48, of 3595 W. Fisher Rd., Victory Township, was arrested Aug. 28 by the Mason County Sheriff’s Office (MCSO) on three felony counts of assault/resisting/obstructing police. Probable cause hearing: Sept. 8 at 11:15 a.m. Bail: $5,000 personal recognizance.

Fitch

-Donald Glenn Fitch, 38, of 3803 Hidden Forest View, Amber Township, was arrested July 20 by Ludington Police Department (LPD) on a felony charge of possession of a controlled substance (methamphetamine/ecstasy). Probable cause hearing: Sept. 8 at 11:15 a.m. Bail: $5,000 personal recognizance.

Esparza-Kenyon

-Julianita Esparza-Kenyon, 26, of 3884 N. Lakeshore Dr., Hamlin Township, was arrested Aug. 26 by Michigan State Police (MSP) on a felony charge of possession of a controlled substance (methamphetamine/ecstasy). Probable cause hearing: Sept. 8 at 11:15 a.m. Bail: $5,000 personal recognizance.

Flannery

-Justin Tyler Flannery, 27, of 423 N. William St., Ludington, was arrested Aug. 31 by MCSO on a felony charge of possession of a controlled substance (methamphetamine/ecstasy) and a misdemeanor charge of driving while license suspended. Probable cause hearing: Sept. 15 at 11:15 a.m. Bail: $1,000 cash.

Misdemeanors 

-Lori Margaret Snyder, 42, of 105 Fifth St., Apt. R, Ludington; Aug. 27; LPD; driving while license suspended (DWLS). Pretrial: Sept. 20 at 2 p.m. Bail: $100 cash.

-Tammy Louise Tanis, 57, of 110 E. Melendy St., Ludington; Aug. 26; LPD; two counts of third degree retail fraud. Pretrial: Sept. 20 at 2 p.m. Bail: $2,500 cash.

-Jeremy Edward Iteen, 44, of 910 N. Emily St., Apt. A1, Ludington; Aug. 26; LPD; operating a vehicle while intoxicated (OWI). Pretrial: Sept. 20 at 1:30 p.m. Bail: $250 cash.

-Tina Ann Rose, 40, no address listed; Sept. 1; MCSO; breaking and entering a vehicle to steal property. Pretrial: Sept. 13 at 1 p.m. Bail: $500 cash.

-Stephanie Josephine Melven, 36, of 7767 S. Comstock Ave., Fremont; Aug. 28; MCSO; operating a vehicle with a blood alcohol content of .17 or more. Pretrial: TBD. Bail: $250 cash.

Sentencings

-Rodney Elwyn Smith, 72, of 4932 N. US 31, Sherman Township, pleaded guilty Aug. 31 to fourth-degree child abuse and attempted distributing sexually explicit matter to a child and was sentenced to one year discretionary jail for one year; must continue current counseling program and $645 in fines/costs.

-Justin Ray Harper, 38, of 16400 Upton Rd., Lot 255, East Lansing, pleaded guilty Aug. 31 to domestic violence and was sentenced to one year discretionary jail for one year; must continue current counseling program and $595 in fines/costs.

-Mickel Edward Bogner, 27, of 5518 King Dr., Pere Marquette Township, pleaded guilty Aug. 31 to operating a vehicle while impaired by liquor (OUIL) and was sentenced to 93 days discretionary jail for one year; no drugs/alcohol; subject to random PBTs; must attend victim’s impact panel; must complete alcohol highway safety education; and $895 in fines/costs. Conviction is reportable to Secretary of State (SOS). A charge of refusing a preliminary breath test was dismissed.

-Lancelot Christopher Peebles, 28, of 306 E. State St., Scottville, pleaded no contest Aug. 31 to domestic violence and was sentenced to 93 days in jail.

-Scott James Henke, 41, of 107 E. Pere Marquette St., Ludington, pleaded guilty Aug. 31 to operating a vehicle while intoxicated (OWI) and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol; subject to random PBTs; must complete alcohol highway safety education; and $895 in fines/costs. Conviction is reportable to SOS.

-Elijah Paul Kmiecik, 18, of 2946 E. Sugar Grove Rd., Sherman Township, pleaded guilty Aug. 31 to underage OUIL with a blood alcohol level between .02-.07 and was sentenced to perform 20 hours of community service within six months; must attend victim’s impact panel; must seek and maintain employment if not enrolled in school; no drugs/alcohol; subject to random PBTs; must continue current counseling program; and $895 in fines/costs. Conviction is reportable to SOS.

-Tammy Lee Moore, 40, of 11485 E. Four Mile Rd., Leroy, pleaded guilty Aug. 25 to malicious destruction of personal property and was sentenced to 93 days discretionary jail for one year; no drugs/alcohol; must attend AA two times per week; subject to random PBTs; must continue current counseling program; and $354 in fines/costs/restitution. A charge of malicious destruction of a building was dismissed.

Dismissals

-Izelia Maldonado, 26, of 111 W. Willow St., Lansing, had a charge of assault with a dangerous weapon (felonious assault) dismissed on Aug. 25.

-Devon Joseph Edwin Wakelin, 24, of 201 S. Rath Ave., Ludington, had three counts of assault/resisting/obstructing a police officer dismissed on Sept. 1.
