79th District Court sentencings and dismissals, posted Dec. 3, 2020.

The following were recently sentenced in Mason County’s 79th District Court:
-Dylan Todd Sorensen, 25, of 3875 N. US-31, Victory Township, pleaded guilty Dec. 2 to domestic violence and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must have a substance abuse evaluation; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $595 in fines/costs. Charges of assault with intent to do great bodily harm less than murder and assault with intent to commit sexual penetration were dismissed.
-Kevin Michael Hackert, 50, of 3122 S. Palmer Blvd., Pere Marquette Township, pleaded guilty Dec. 1 to operating a vehicle while impaired by liquor (OWIL) and was sentenced to 32 days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact weekend; no drugs/alcohol; subject to random PBTs; and $895 in fines/costs. Conviction is reportable to Secretary of State (SOS).
-Brian Felix Vaillancourt, 26, of 406 N. Staffon St., Ludington, pleaded guilty Dec. 1 to operating a vehicle while intoxicated (OWI) and was sentenced to 32 days in jail with credit for two days served; 93 days discretionary jail for two years; must attend victim’s impact panel; must obtain Soberlink for six months; must attend AA two times per week; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $1,275 in fines/costs. Conviction is reportable to Secretary of State (SOS). Charges of operating with a blood alcohol level over .17 and transporting and open intoxicant in a motor vehicle were dismissed.
-Jeffrey Allen Spurgess, 50, of 208 S. Robert St., Apt. 13, Ludington, pleaded guilty Dec. 1 to OWIL and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for two years; must obtain Soberlink for six months; must attend victim’s impact panel; no drugs/alcohol/marijuana/ subject to random PBTs and drug tests; must obtain substance abuse and family counseling; and $1,075 in fines/costs. Conviction is reportable to SOS. A charge of operating a vehicle with a blood alcohol level over .17 was dismissed.
-Zachary Scott Austin, 33, of 603 S. Madison St., Ludington, pleaded guilty Dec. 1 to disorderly person jostling and was sentenced to two days in jail with credit for two days served; 90 days discretionary jail for one year; must have an anger management and/or mental health examination; no drugs/alcohol; subject to random PBTs and drug tests; and $285 in fines/costs. A charge of second offense domestic violence was dismissed.
-Christopher Lee Myers, 34, of 6275 S. Sheridan Dr., Muskegon, pleaded no contest Dec. 1 to using a controlled substance and was sentenced to one year discretionary jail for two years; must attend NA/AA two times per week; no drugs/alcohol/marijuana; subject to random drug tests and PBTs; and $745 in fines/costs. Charges of possession of controlled substance and habitual offender were dismissed.
-Elizabeth Katherine Gonzalez, 50, of PO Box 6343, Traverse City, pleaded guilty Dec. to trespassing and was sentenced to two days in jail with credit for two days served; 30 days discretionary jail for one year; must have a substance use evaluation; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $185 in fines/costs. A charge of breaking and entering was dismissed.
-Jay Ralph Lavengood, 62, of 512 W. Pere Marquette, Big Rapids, pleaded guilty Nov. 24 to OWIL and was sentenced to 31 days in jail with credit for one day served; 93 days discretionary jail for two years; must attend victim’s impact panel; must have substance abuse evaluation; no drugs/alcohol; subject to random PBTs; and $1,075 in fines/costs. Conviction is reportable to SOS. A charge of marine safety – operating under the influence of liquor was dismissed.
-Richard Massey Thomas, 34, of 410 S. Washington Ave., Apt. 1, Ludington, pleaded guilty Nov. 24 to OWI and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact panel; must attend AA two times per week; no drugs/alcohol/marijuana; subject to random drug tests and PBTs; must continue current counseling program; and $1,095 in fines/costs. Conviction is reportable to SOS.
-Daniel Richard Madden, 33, of 1051 W. White Rd., Grant Township, pleaded guilty Nov. 24 to OWI and was sentenced to 31 days in jail with credit for one day served; 93 days discretionary jail for two years; must attend victim’s impact panel; no drugs/alcohol; subject to random PBTs; must continue SBIRT program; and $1,375 in fines/costs. Conviction is reportable to SOS.
Dismissals
-Brittany Marie Wiles, 29, of 2216 S. Scottville Rd., Custer Township, had a charge of domestic violence dismissed without prejudice on Nov. 30 after entering into a prosecutor’s deferral agreement.
-Jeffrey Allen Kaiser, 58, of 209 S. Rowe St., Ludington, had charges of assault with a dangerous weapon and felony firearms dismissed without prejudice on Dec. 2. According to court records, “Defendant was writ to preliminary hearing but was unable to be transported due to COVID restrictions.”
