LUDINGTON — A 31-year-old Ludington man pleaded guilty in 51st Circuit Court Tuesday, April 24, to one count of embezzlement from a vulnerable adult $1,000-$20,000 and one count of uttering and publishing.
David Phillip Frank, of 308 E. Foster St., testified that he stole checks from a man he was caring for in Grand Rapids and then cashed the checks at a bank in Mason County.
One count of embezzlement from a vulnerable adult and one count of uttering and publishing were dismissed in exchange for his guilty plea. The plea agreement calls for Frank serving 10 months up front of a one-year discretionary jail term.
“I was taking care of him, and (the check) was laying there on the floor and I just took it,” Frank told Judge Susan K. Sniegowski.
Frank’s attorney, David Glancy, said his client cashed eight checks totaling $24,000.
Sentencing is set for June 5 at 1:30 p.m.
