Hart man sentenced to jail for break-in.

LUDINGTON — A 46-year-old Hart man was sentenced to serve nine months up front of a one-year discretionary jail term for a conviction of breaking and entering with intent in 51st Circuit Court Tuesday, Feb. 27.
Roy James Alltop, of 3745 132nd Ave., was also convicted in Oceana County’s 27th Circuit Court of larceny in a building $1,000-$20,000 and breaking and entering a building with intent after pleading guilty to the charges, Feb. 16. His sentence will run concurrently to the Oceana case, said Mason County Prosecutor Paul Spaniola.
Alltop testified that he broke into an unlocked pole barn on Eden Lake Road in Eden Township and stole “a 4-inch grinder and little pack of tools.”
In 79th District Court, Alltop is charged with second-offense operating while intoxicated following a crash that injured his passenger, Blair Rochelle Collins, 27, of Hart. Collins was trapped inside the vehicle and suffered fractured legs and ankles. His circuit court sentence runs concurrently to that case, Spaniola said.
The prosecutor said that Alltop and his girlfriend, Collins, both have drug problems. “She attributes her drug problem to Mr. Alltop.”
Alltop’s attorney, David Glancy, agreed, citing “underlying substance issues.”
Alltop has one prior felony and eight misdemeanor convictions, the prosecutor said.
He received credit for 112 days served in jail, and was ordered to two years probation
