51st Circuit Court sentencings

LUDINGTON — The following were sentenced recently in 51st Circuit Court:

– Nicholas Brian Lauterwasser, 22, of 186 S. Walhalla Rd., Fountain, was found guilty April 7 of two counts of assaulting, resisting, obstructing a police officer and third-offense habitual offender. He was sentenced May 12 to two concurrent terms of two years and one month to four years in a Michigan Department of Corrections (MDOC) prison with credit for 139 days served and $266 in fines and costs. In a separate file, he was found guilty April 7 of domestic violence and third-offense habitual offender. He was sentenced May 12 to two years and three months to 10 years in prison with credit for 139 days served and $198 in fines and costs. One count of interfering with an electronic communications device was dismissed. In another file, he was found guilty of probation violation May 12 and sentenced to one year and six months to four years in prison with credit for 438 days served. His probation, which was revoked, stems from a Sept. 20, 2011 conviction of assault – weapon. Prison terms are concurrent. Related story here

– Albert Eugene Benjamin, 42, of 122 Pine St., Prudenville, Mich., was found guilty March 17 of failure to register. He was sentenced May 13 to one year in jail with credit for three days served; serve 10 months up front/balance to be served at the court’s discretion; two years probation; and $398 in fines and costs. One count of sex offender, failure to register, and one count of fourth-conviction habitual offender were dismissed.

– Andrea Benet Pena, 35, of 909 S. Washington Ave., Ludington, was found guilty April 7 of controlled substance, possession of marijuana. She was sentenced May 12 to 180 days in jail with credit for 72 days served; serve three months up front/balance to be served at the court’s discretion; and $125 in fines and costs. One count of possession of a non-narcotic was dismissed. In a separate file, she was found guilty April 7 of controlled substance, possession of a non-narcotic. She was sentenced May 12 to one year in jail with credit for 72 days served; serve three months up front/balance to be served at the court’s discretion; $498 in fines and costs; one year probation; and driver’s license suspended 180 days/restricted after 30 days. Sentences are concurrent.

– Megan Nicole Nellett, 24, of 2071 Lara Dr., Traverse City, was found guilty May 12 of probation violation and sentenced to 60 days in jail. Probation stems from a Nov. 22, 2011 conviction of receiving and concealing property $1,000-$20,000.

– Dayvin Michael Flickinger, 22, of 406 E. Foster St., Apt. 3, Ludington, was found guilty April 7 of false report or threat of a bomb. He was sentenced May 12 to one year in jail with credit for 147 days served; serve eight months up front/balance to be served at the court’s discretion; 90 days on electronic monitoring after release from jail; may attend inpatient treatment; no contact with Tendercare; two years probation; and $498 in fines and costs. – Benjamin James Rhinebolt, 54, of 207 Thomas St., Scottville, was found guilty March 17 of third-offense operating under the influence of liquor (OUIL). He was sentenced May 12 to one year in jail with credit for two days served; serve five months up front/balance to served at the court’s discretion; work release must meet Mason County Sheriff’s Office (MCSO) guidelines; 360 hours of community service; one year vehicle immobilization; not to operate a vehicle without interlock device; $1,048 in fines and costs; and one year probation.
