LUDINGTON – The following defendants were sentenced this past week in 51st Circuit Court:
–         Melissa Sue Streeter, 40, of 202 S. Rowe St., Apt. B, Ludington, was found guilty June 27 of controlled substance delivery, less than 50 grams, second offense. She was sentenced Aug. 20 to 330 days in jail with credit for 99 days served; serve 10 months forthwith; balance to be served at the court’s discretion; 18 months probation; and $598 in fines, costs and restitution. Sanctions reportable to the Michigan State Police (MSP) – driver’s license suspended 60 days, restricted 305 days. She was convicted and sentenced of a second count of controlled substance delivery, less than 50 grams, second offense in a separate file and received the same sentence as the first count, and the two sentences run concurrent. A third count of controlled substance delivery, less than 50 grams, second offense was dismissed.
–         Derek Kevin Holtrey, 43, of 1221 E. Wilson Rd., Scottville, was found guilty June 27 of operating under the influence of liquor (OUIL), third offense, and habitual offender, third conviction. He was sentenced Aug. 20 to 365 days in jail with credit for 75 days served; serve eight months forthwith; balance to be served at the court’s discretion; work release must meet Mason County Sheriff’s Office (MCSO) guidelines; may be released to an inpatient substance abuse treatment center for a minimum of 30 days after serving seven months and receive day-to-day credit; 36 months probation; $1,048 in fines and costs; and 50 days community service. Conviction reportable to the Secretary of State (SOS). One count of driving while license suspended (DWLS), second offense, was dismissed.
–         Chad Heitz, 34, of 3677 S. Pere Marquette Highway, was found guilty June 27 of attempted criminal sexual conduct (CSC), third degree, 13-15 year old person. He was sentenced Aug. 20 to 365 in days in jail with credit for 32 days served; serve nine months forthwith with balance to be served at the court’s discretion; 60 months probation; $648 in fines and costs; and no contact with the victim. Three counts of CSC, third degree, 13-15 year old person, were dismissed.
–         Daniel Richard Rybicki, 42, of 11227 N. Custer Rd., Free Soil, was found guilty June 27 of OUIL, third offense, and pleaded no contest to attempted assaulting/resisting/
–         Robert James Miller, 41, of 4689 S. Stiles Rd., Ludington, was found guilty June 27 of CSC, first degree, a person under 13 years, and habitual offender, second offense. In a separate file, he was also found guilty June 27 of CSC, second degree, person under 13 years, and habitual offender, second offense. In the first case, he was sentenced to a minimum of 25 years to a maximum of 50 years with the Michigan Department of Corrections (MDOC), with credit for 162 days served in jail; and $198 in fines and costs. In the second case, he was sentenced to a minimum of five years to a maximum of 22 years, six months with the MDOC; and $198 in fines and costs. The sentences run concurrent. He is required to be on lifetime GPS upon release from prison. One count of CSC, first degree, a person under 13 years, and CSC, second degree, person under 13 years, second offense, were dismissed.
–         Bryan Dale Olson, 143 N. Jebavy Dr., Apt. 1, Ludington, was found guilty July 18 of failure to register and habitual offender, third offense. He was sentenced Aug. 20 to a minimum of one year, three months, to a maximum of eight years with MDOC and $198 in fines costs. Two counts of failure to register and one count of habitual offender, fourth offense, were dismissed. The sentence is to run consecutively to a parole violation case.
–         Amy Jo Thrailkill, 40, of 6618 N. Oceana Dr., Hart, was found guilty June 11 of embezzlement agent $1,000-$20,000. She was sentenced Aug. 20 to 180 days in jail; 12 months probation; serve 90 days forthwith with balance to be served at the court’s discretion; may serve sentence in Oceana County; work release authorized if sentence served in Oceana County; and $4,648 in fines, costs and restitution. Three counts of embezzlement from a financial institution were dismissed.
